Jimmy Lai, a prominent figure in Hong Kong known for his pro-democracy stance and vocal criticism of Beijing, has been handed a 20-year prison sentence in a high-profile trial related to the national security law imposed by China. Judge Esther Toh specified that 18 years of Lai’s sentence are to be served consecutively with his previous fraud conviction, which resulted in a jail term of five years and nine months. Lai retains the option to appeal the verdict.
In addition to Lai, six former employees of his Apple Daily newspaper and two activists were also sentenced to prison terms ranging from 6¼ to 10 years on charges related to collusion. Despite facing serious accusations of conspiring with foreign forces and publishing seditious articles, Lai, aged 78, was spared the maximum sentence of life imprisonment by three government-approved judges. This decision could potentially see Lai spending the remainder of his life in prison.
The sentencing of Jimmy Lai has garnered global attention and criticism, with U.S. Secretary of State Marco Rubio and Canadian Foreign Affairs Minister Anita Anand calling for his release on humanitarian grounds. Rubio condemned the severe sentence as a means for Beijing to suppress advocates of fundamental freedoms in Hong Kong.
Lai’s legal team highlighted his deteriorating health conditions, including heart palpitations, high blood pressure, and diabetes, emphasizing the harsh impact of the “draconian” prison term on his well-being. Lai’s son and sister expressed deep distress over the sentence, characterizing it as unjust and potentially life-threatening. Despite the adversity, Lai’s son remarked that his father’s spirit remains unbroken, citing his defiant reaction during the court proceedings.
The trial and imprisonment of Jimmy Lai have raised concerns about the diminishing press freedom in Hong Kong, once considered a stronghold of media independence in Asia. The government defended its actions, claiming that the defendants misused journalism as a cover to undermine China and Hong Kong. Lai’s arrest under the national security law in 2020 marked a significant turning point, leading to subsequent arrests of senior journalists and the eventual closure of Apple Daily in 2021.
International condemnation of Lai’s sentencing has been widespread, with calls for his release from various political figures and organizations worldwide. The Inter-Parliamentary Alliance on China and the European Union urged democratic governments to respond collectively to the erosion of Hong Kong’s autonomy and fundamental rights. Amnesty International labeled Lai’s imprisonment as a grave violation of human rights and emphasized the disregard for dignity in punishing a 78-year-old for exercising his freedom of expression. China’s Foreign Ministry maintained that Lai’s case falls within Hong Kong’s jurisdiction and cautioned against external interference in judicial matters.
