ABC Sues FCC Over License Review Threat

ABC has taken legal action against the FCC, claiming that the agency’s requirement for early review of broadcast licenses is a threat to its operations. The lawsuit, filed by ABC and its parent company Disney, along with eight local stations, seeks to halt the early renewal proceedings initiated by FCC chairman Brendan Carr, a supporter of President Trump. The FCC’s decision to review ABC’s licenses early was prompted by concerns over the network’s diversity practices, following a controversial joke made by ABC’s late-night host, Jimmy Kimmel.

ABC alleges that the Trump administration has targeted its freedom of speech and is seeking to have its broadcast licenses revoked due to its viewpoints. The network asserts that it has no option but to seek legal intervention to protect its First Amendment rights. ABC is urging the court to prevent the FCC from taking any action against them regarding the early license renewal applications.

The conflict between ABC and the FCC has been ongoing, with additional disputes arising over the application of equal-time rules to ABC’s morning talk show, “The View.” ABC argues that the FCC’s actions are part of a broader campaign against free speech that extends beyond ABC and could have far-reaching implications for media companies nationwide.

Anna Gomez, the sole Democrat on the commission, praised ABC and Disney for challenging the FCC’s actions, condemning what she perceives as censorship and government intimidation. Meanwhile, FCC chairman Brendan Carr defended the agency’s stance, emphasizing broadcasters’ responsibility to serve the public interest.

The FCC reiterated its position that all broadcasters, including Disney, must operate in the public interest, citing ongoing examinations into claims of diversity discrimination by Disney. The FCC affirmed its commitment to upholding the law and investigating the matter further despite Disney’s legal challenge.
