Harvey Weinstein will not be tried for a fourth time on a rape charge in New York as prosecutors have dropped the case following the accuser’s reluctance to testify again. Despite remaining convicted of a separate sexual offense in New York and others in California, Weinstein is currently incarcerated. The unresolved New York rape charge stemmed from a previous overturned conviction and two mistrials.
Jessica Mann, a hairstylist and actress, testified in all three trials, alleging that Weinstein raped her in a Manhattan hotel in 2013. She detailed her relationship with him before and after the incident, while Weinstein maintained that their interactions were consensual. Mann expressed her inability to continue with the case in a letter quoted by prosecutor Nicole Blumberg, citing the prolonged distress caused by the eight-year legal ordeal.
Recognizing Mann’s courage, prosecutors decided to dismiss the case in consideration of her emotional well-being. After the court’s formal dismissal, Weinstein, who is currently serving a New York sentence for a separate assault, awaits sentencing in September, with prosecutors seeking a 20-year prison term.
Following his New York proceedings, Weinstein faces a 16-year sentence in California for another rape conviction, which he is appealing. His legal team welcomed the dismissal of Mann’s allegation, asserting his innocence and criticizing the initial charges.
