“Ottawa Man Admits Manslaughter in Spouse’s Passing”

An Ottawa resident, Philippe Hébert, confessed to manslaughter in the 2022 passing of his ailing spouse of four decades, expressing an inability to continue living without his significant other despite their failed suicide pact. During the sentencing hearing, Hébert, 72, disclosed that his late partner, Richard Rutherford, 87, had a fulfilling life but desired to cease living. The discovery of Rutherford’s lifeless body on April 15, 2022, at their Smyth Road residence led to Hébert’s arrest and second-degree murder charge. However, in September, he admitted to manslaughter to avoid a trial by jury.

Both the prosecution and defense have not provided sentencing recommendations, with three days allocated for determining Hébert’s penalty. Hébert has been mainly under custodial supervision since his apprehension. Rutherford, a former distinguished dancer at the Royal Winnipeg Ballet, is remembered for his dance contributions and community involvement.

As per an agreed-upon statement, Hébert informed the 911 operator on the night of Rutherford’s demise that his spouse, facing various health challenges including recent cancer diagnosis, requested him to end his life. Although Hébert, overwhelmed by Rutherford’s declining health, agreed to fulfill this wish, he informed paramedics that he couldn’t carry out his own demise as agreed upon.

The court learned that Hébert had previously attempted suicide out of fear that Rutherford would pass away alone in the hospital during the COVID-19 crisis. Despite their discussions with a physician about medical assistance in dying (MAID), they did not proceed. Hébert believed Rutherford did not meet the qualifications for MAID.

On the day of Rutherford’s death, Hébert obtained permission to admit his spouse to long-term care. Rutherford reiterated his desire to die, an act Hébert found distressing. Hébert made unsuccessful attempts to end his own life and contacted emergency services due to the illegal nature of his actions. While Hébert has no regrets about honoring his partner’s wishes, he is grappling with the aftermath.

Throughout his court appearances, Hébert has received support from a large contingent of family, acquaintances, and neighbors familiar with both men. The sentencing hearing for Hébert will continue the following day.
